These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "user," or "customer") and Allfunride ("Company," "we," "us," or "our"), governing your access to and use of the website, including any content, functionality, products, and services offered through allfunride.com (the "Site").
By accessing or using the Site, or by purchasing any product from us, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Site.
We reserve the right, in our sole discretion, to modify these Terms at any time. Continued use of the Site after any such changes constitutes acceptance of the revised Terms.
Your affirmative act of using the Site or purchasing from us constitutes electronic acceptance of these Terms under applicable law.
By using this Site, you represent and warrant that:
- You are at least the age of majority in your jurisdiction; or
- You have obtained consent from a parent or legal guardian, if applicable.
You may not use our products or services where such use is prohibited by applicable law.
3. IMPORTANT SAFETY NOTICE & ASSUMPTION OF RISK
Allfunride products include, without limitation, electric bicycles, electric scooters, electric skateboards, electric dirt bikes, and electric motorcycles (collectively, "Electric Mobility Products").
You expressly acknowledge and agree that:
- Electric Mobility Products involve inherent and significant risks, including but not limited to serious bodily injury, permanent disability, or death;
- Risks may arise from mechanical failure, loss of control, collision, road conditions, weather conditions, user error, product misuse, modification, or third-party conduct; and
- You voluntarily assume all risks associated with the use, operation, transportation, charging, storage, and maintenance of such products.
You agree that you are solely responsible for:
- Determining whether you are physically and mentally capable of operating the product safely;
- Ensuring proper use, maintenance, inspection, charging, and storage;
- Reviewing and complying with all applicable local laws, regulations, licensing requirements, and traffic rules in your jurisdiction; and
- Determining whether a product is lawful to use on public roads, bike lanes, trails, or other areas in your jurisdiction.
- We strongly recommend the use of certified protective equipment, including helmets and protective pads, at all times.
4. NO PROFESSIONAL OR SAFETY WARRANTIES
All content provided on the Site is for general informational purposes only. Nothing on the Site constitutes professional advice, including safety, engineering, legal, regulatory, or technical advice.
Except as otherwise expressly stated in a separate written warranty policy, all products and services are provided on an "AS IS" and "AS AVAILABLE" basis.
5. PRODUCT WARRANTY; DISCLAIMER OF ADDITIONAL WARRANTIES
Certain products may include a limited warranty, the scope, duration, and eligibility of which may vary by brand and model. Product-specific warranty information, including any brand-specific terms, may be displayed on the relevant product page, in a separate Warranty Policy, or in documentation provided with the product.
Except for any limited warranty expressly provided in writing, and to the fullest extent permitted by applicable law, we disclaim all other warranties, express or implied, including without limitation merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms is intended to override any non-waivable rights you may have under applicable consumer protection law.
6. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Allfunride, its directors, officers, employees, affiliates, agents, suppliers, and licensors shall not be liable for any:
- Direct, indirect, incidental, consequential, punitive, or special damages;
- Personal injury, death, property damage, or loss arising from product use, misuse, modification, or inability to use a product;
- Loss of profits, revenue, data, goodwill, or business opportunities; or
- Unauthorized access to, alteration of, or use of your transmissions, account information, or content.
This limitation applies regardless of the legal theory asserted, including contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.
7. PRODUCT INFORMATION & DISCLAIMERS
We strive to ensure product descriptions, specifications, compatibility information, availability, and pricing are accurate; however, we do not guarantee that all information is complete, current, or error-free.
All specifications including, without limitation:
- Range
- Speed
- Torque
- Battery life
- Charging time
- Climbing performance
- Payload capacity
are estimates based on controlled or manufacturer-provided testing conditions. Actual performance may vary significantly due to environmental, technical, maintenance-related, and user-specific factors.
We reserve the right to correct any errors, inaccuracies, or omissions and to modify or discontinue any product at any time without prior notice.
8. ORDERS, ACCEPTANCE & CANCELLATION
We reserve the right to:
- Refuse or cancel any order at any time for any lawful reason;
- Limit or restrict quantities purchased per person, household, address, payment method, or order; and
- Reject orders suspected of reseller, distributor, automated purchasing, fraudulent, or unauthorized activity.
We may require additional verification before accepting an order.
Order cancellation, returns, exchanges, and refunds may be subject to separate policy terms published on the Site, including any applicable Return & Refund Policy. Where such separate policies apply, they are incorporated into these Terms by reference.
9. SHIPPING, LOCAL WAREHOUSE FULFILLMENT, TAXES & IMPORT DUTIES
Shipping times, fulfillment origin, and delivery estimates vary by product, destination, stock availability, and carrier conditions. Some products may ship from local US or EU warehouses, while other products may ship internationally depending on availability and destination.
Where a product is fulfilled from a local US or EU warehouse, the product page and/or checkout page may indicate that applicable duties or taxes are included in the displayed purchase price or collected at checkout. For other products, including certain internationally shipped items, additional customs duties, import taxes, brokerage charges, or local fees may apply and may remain the responsibility of the customer unless expressly stated otherwise.
The customer is responsible for reviewing the product page, shipping policy, and checkout information before placing an order. Where required by law or shipping method, the recipient may be treated as the importer of record and may be responsible for customs clearance procedures and related charges.
10. PAYMENT & ACCOUNT INFORMATION
You agree to provide current, complete, and accurate purchase and account information for all transactions made through the Site.
We reserve the right to:
- Refuse any transaction;
- Cancel orders suspected of fraud or unauthorized activity; and
- Require updated billing, identification, or verification information before processing an order.
If we make available third-party payment, financing, or installment options, including but not limited to Klarna or Afterpay, such services are provided by independent third parties and may be subject to those third parties' own terms, approval criteria, privacy practices, and payment conditions. We are not responsible for decisions made by such third-party providers.
11. INTELLECTUAL PROPERTY
All content on the Site, including text, images, graphics, logos, trademarks, product designs, software, and other materials, is the property of Allfunride or its licensors and is protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, display, publish, modify, create derivative works from, or commercially exploit any content without prior written consent.
12. USER CONTENT
If you submit or post any content, including reviews, feedback, suggestions, photographs, videos, ideas, or testimonials, you grant Allfunride a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, distribute, and display such content for any lawful purpose.
You represent and warrant that:
- You own or control all rights in and to the content you submit;
- Your content does not violate any third-party rights or applicable law.
13. PROHIBITED USE
You agree not to use the Site:
- For any unlawful purpose;
- To violate any applicable laws or regulations;
- To infringe intellectual property, privacy, publicity, or other third-party rights;
- To introduce malware, viruses, ransomware, or other harmful code;
- To engage in scraping, data mining, automated extraction, or unauthorized bots;
- To interfere with website security, performance, or functionality;
- To misrepresent identity or provide false information; or
- To attempt to bypass security controls, fraud checks, or payment verification systems.
We reserve the right to suspend or terminate access for violations.

You agree to indemnify, defend, and hold harmless Allfunride and its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any claims, damages, liabilities, losses, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- Your use or misuse of the Site or products;
- Your violation of these Terms;
- Your violation of any law, regulation, or third-party right; or
- Your negligence, misconduct, modification of products, or unlawful operation of Electric Mobility Products.
We may suspend or terminate your access to the Site at any time, with or without notice, for any violation of these Terms or for any other lawful reason at our sole discretion.
17. GOVERNING LAW & DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws specified in the legal notices, checkout terms, or other governing policy published on the Site, without regard to conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any purchase may be resolved through binding arbitration or in a court of competent jurisdiction, subject to applicable law, mandatory consumer rights, and any dispute resolution terms separately published on the Site.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severed from these Terms and shall not affect the validity and enforceability of the remaining provisions.
